Referral Program Terms & Conditions
WinChoice USA, LLC (“WinChoice”) will provide referral incentives to its homeowner customers, subject to these Terms and Conditions.
Incentive Description & Eligibility: Homeowners who have purchased installed windows and/or doors from WinChoice are eligible to receive referral incentives under the program. Following installation of your WinChoice products, you will receive a referral code from WinChoice via email or the WinChoice mobile application. If a referral completes an in-person demonstration of WinChoice windows and submits your code at the time of product demonstration, you will receive $250 following the referral’s completed WinChoice windows product demonstration; subsequent demonstrations by the same referral are not eligible for incentives. WinChoice, in its sole discretion, may substitute a similar incentive. Employees or agents of WinChoice and its affiliates, subsidiaries, advertising/promotional/PR agencies, and the members of their immediate families or those persons living in the same household of such individuals are ineligible for incentives.
Referral Period: This incentive program may be modified or cancelled by WinChoice USA at any time in its sole discretion without notice or liability.
Taxes: Participant is responsible for all taxes associated with any referral benefits received under the program. If participants make three or more qualified referrals in a given calendar year, participant will be required to submit documentation, as requested by WinChoice, sufficient to process a Form 1099 prior to your receipt of the incentive.
Miscellaneous: All issues and questions concerning the incentive program, including without limitation the construction, validity, interpretation and enforceability of these Terms and Conditions, shall be governed by, and construed in accordance with the laws of the State of Arkansas, USA, without giving effect to any choice of law or conflicts of law rules or provisions whether the State of Arkansas or any other jurisdiction that would cause the application of the laws of any jurisdiction other than the State of Arkansas. Any and all disputes, claims, and causes of action arising out of or in connection with this incentive shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall be subject to the exclusive jurisdiction of the federal or state courts within the State of Arkansas, USA. WinChoice’s liability for any claim howsoever relating to this incentive shall be absolutely limited to an aggregate amount of $250; and by participating in this program, you waive all rights to claim, punitive, incidental, and consequential damages, and any other damages, and any and all rights to have damages multiplied or otherwise increased.
